1.- Who owns the Isabel Guarch online shop?
The contracts of sale of the objects advertised on the website www.isabelguarch.com are entered into with the company Guarch Collection S.L., holder of Tax Identification Code B-57592586, with registered office in 07011 Palma de Mallorca (Balearic Islands), calle Francisco Martí i Mora 1, esc. A piso 14, and postal address in 07001 Palma de Mallorca (Balearic Islands), Plaça des Mercat, 16.

2.- Age of majority
Guarch Collection S.L. only sells its products to persons of legal age in accordance with Spanish legislation (article 315 of the Civil Code). Therefore, if you are not 18 years of age you cannot buy through our virtual shop. The user is solely responsible for the veracity of any data entered in the various forms of the virtual shop.
3.- Characteristics of the products.
The main characteristics of each jewel are described in their corresponding files, which can be accessed by clicking on the photo of each product.
4.- Prices.
Prices are expressed in Euros and can only be paid in this currency. In the event that the billing address is in a currency other than the currency of the country of delivery, your bank may charge you an exchange rate or commission, which is beyond our control.
Unless expressly stated otherwise in the specific product information, the price indicated includes Value Added Tax (VAT) at the applicable rate in each case. If this is not included, the rate applicable to each product will be specified in the product information provided.
5.- Shipping costs and delivery time.
The sale price of the product indicated on the website does not include shipping costs.
Peninsula and Balearic Islands
Shipments to Peninsula and Balearic Islands are free, if you choose the standard mode of delivery. If you choose another delivery method, if any, shipping costs will be indicated at the time of making your choice in the fourth step of the purchase process. The delivery time is between 3 and 4 working days. For these purposes, working days are understood to be Monday to Friday, excluding public holidays. The term will be counted from the day following the payment verification.
European Union and U.K.
The shipment can be made by registered post or by parcel/transport company.
Delivery by registered post is free of charge and the delivery time is 20 working days. For these purposes, working days are understood to be the days from Monday to Friday, except for public holidays. The term will be counted from the day after the payment is verified.
Delivery by parcel/transport company has a cost of 29.-€ and the delivery time is between 3 and 4 working days. For these purposes, working days are understood to be the days from Monday to Friday, except public holidays. The deadline will be counted from the day after the payment is verified.
Non-European Union
The delivery to countries outside the European Union has a cost of 49.-€ and the delivery time is between 7 and 10 working days. For these purposes, working days are understood to be Monday to Friday, excluding public holidays. The deadline will be counted from the day after the payment is verified.
Pick up in-store
You can pick up your jewellery in our shop located in Plaza des Mercat 16, 07001 Palma, or in our corner located in El Corte Ingles de Jaime III, 07012 Palma during business hours from the day after your purchase, with prior identification. Please add in the comments box the place and date of collection.
In the event that the purchased good(s) cannot be delivered within the aforementioned deadlines, delivery may not be delayed beyond 30 calendar days from the date of purchase of the product. If, despite this, the product is still not delivered, the purchaser is entitled to call upon Guarch Collection S.L. to comply within a further period of time appropriate to the circumstances. If the entrepreneur fails to deliver the goods within such additional period, the consumer and user shall be entitled to terminate the contract, and the seller shall be obliged to reimburse, without undue delay, all amounts paid by the buyer under the contract.
6.- Right of withdrawal.
If when you receive your order you are not satisfied, you have a period of 14 calendar days, counting from the date of receipt, to execute the right of withdrawal from the contract of sale, without penalty of any kind and without the need to express any cause.
The right of withdrawal shall not apply to purchases of items that have been customised according to the customer's instructions.

Whether by one means or another, your communication must contain the following data:
- Your identification details: full name and address
- Order number as stated on the invoice sent to you with the purchased goods
- Description of the goods purchased
- Your wish to withdraw from the contract of sale
- Bank account where you want the price and costs to be refunded
- Date of coummunication
- If you send your request by non-electronic means (e.g. by post), it must be signed
To comply with the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period, although you will have to duly prove this circumstance.
If you exercise your right of withdrawal in time, we will reimburse to you any payment received from you, including the costs of delivery if they have been charged to you (subject to the limit of those corresponding to the least expensive of the methods made available to you) within 14 calendar days of receipt by us of your communication, although we may withhold payment until we have received the purchased goods or reliable proof of their delivery.
From the date on which you inform us of your decision to withdraw from the contract, you have a period of 14 calendar days to return the purchased goods to us in perfect condition together with a copy of the purchase invoice and the original certificate of authenticity, the cost of the return being borne by the customer, not by this company.

As proof of your return, we recommend that you always keep the receipt from the courier or proof of postage as proof of the fact that you have handed over the parcel for forwarding to this company.
RETURNS will not be accepted in any other Isabel Guarch shop.
7.- Exchanges.
Except for those products purchased in Isabel Guarch shops located in shopping centres or department stores, you can exchange the purchased product for another of equal or greater value, provided that the purchased item is in perfect condition, no more than 20 calendar days have passed since its purchase and accompanied by proof of purchase and certificate of authenticity. These exchanges can only be carried out in person at the central shop Isabel Guarch, located in Plaça del Mercat 16 07001 Palma.

8.- Orders

9.- How can I pay for my order?
The online shop Isabel Guarch supports as payment system credit and debit cards issued by MasterCard and Visa, as well as platforms at all times related on the web.
In your case, there is the possibility of financing your purchases through these platforms, according to the conditions of each of them.
Guarch Collection S.L. does not have access to the number of your credit/debit card, nor to the passwords that you use in the payment platform chosen by you and is not involved in the conditions, requirements or documentation that may be demanded by these platforms for the financing of your purchases.
Only in the event that you make your purchase by telephone or WhatsApp, you will be provided with a bank account number to transfer the price of your purchase. Your purchase will not be dispatched until we have received confirmation from your bank of the payment of the purchase price.

10.- Which currencies can I use?
This company only accepts payments in EUROS.

11.- When will I be charged?
When you place your order and the transaction is authorised by your chosen payment platform, you will receive an e-mail confirming that your order, and the charge, has been successful.
If the transaction is authorised, no charge will appear and you will be notified immediately on the screen that the payment could not be made. You will be asked to provide another method of payment.
12.- Commercial guarantee.
Without prejudice to the above regarding your right of withdrawal, all products sold by Isabel Guarch enjoy the guarantees provided by Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws.
13.- Complaint forms.
At the headquarters of our company, Plaça del Mercat nº 16 07001 Palma de Mallorca, as well as at our other points of sale, you have at your disposal complaint forms, in accordance with article 11 of Law 1/1998 of 10 March, of the statute of consumers and users of the Balearic Islands.

In accordance with the provisions of Article 14.1 of Regulation (EU) No 524/2013 of the Parliament and of the Council of 21 May 2013, we inform you of the existence of the European platform for the alternative resolution of disputes arising from the contracting of products or services offered from this website, which you can access from this link.

In accordance with the provisions of article 29 of Law 34/2002, of 11 July, on information society services and electronic commerce, electronic sales contracts made through this website in which the buyer is a consumer shall be presumed to have been concluded in the place where the buyer has his or her habitual residence. The courts and tribunals of the consumer's place of residence shall have jurisdiction in such cases.
In the event that the buyer is a legal entity, electronic sales contracts made through this website will be understood to have been concluded in the place where Guarch Collection S.L. is established, that is to say, Palma de Mallorca. Consequently, both contracting parties submit themselves, renouncing any other jurisdiction that may correspond to them, to the jurisdiction of the courts and tribunals of the judicial district of Palma de Mallorca.
